Thailand Visa & Work Permit Service for Foreigners — A Complete English-Language Guide
Living, working, retiring, or running a business in Thailand as a foreign national requires navigating a layered immigration system that changes faster than most expats can follow. Between the 2024 launch of the DTV Destination Thailand Visa, the BOI-administered LTR Long-Term Resident program, the relaunched Thailand Privilege (Elite) tiers, and ongoing amendments to Non-B work permit ratios and Non-O retirement deposit rules, even seasoned residents find themselves needing professional help. NYC Legal & Notary Service Co., Ltd. (DBD No. 0435567000061) operates a fully bilingual English/Thai immigration desk staffed by six Notary Public attorneys, in-house translators in 50+ languages, and on-the-ground liaison officers at Bangkok Chaengwattana, Phuket, Pattaya Jomtien, Chiang Mai Promenada, Hua Hin, and Koh Samui immigration offices.
Who We Serve
Our foreign client base spans 78 nationalities. The largest cohorts are American, British, Australian, German, French, Swiss, Dutch, Scandinavian, Japanese, Korean, Chinese, Indian, and Middle Eastern professionals and retirees. Profiles include corporate executives transferring to Thai subsidiaries, founders incorporating Thai Limited or BOI-promoted companies, remote workers and freelancers relocating under DTV, retirees consolidating their golden years in Phuket/Hua Hin/Chiang Mai, foreign spouses of Thai citizens, international school teachers, English instructors, yacht crews, diving instructors, content creators, and HNW individuals using Elite Visa as a base for Southeast Asian travel.
Visa Categories Explained — Choose the Right One the First Time
Non-Immigrant B (Business): The standard work visa, tied to a Thai employer that meets capital (THB 2M paid-up) and Thai-foreign employee ratio (4:1) thresholds. Initial 90 days, extended annually. Requires parallel Work Permit application. Best for traditional employment relationships.
Non-Immigrant O (Marriage): For foreigners legally married to Thai citizens. Requires THB 400,000 in a Thai bank account for 2+ months, or THB 40,000/month income, plus joint household documentation. 1-year extensions, no work permit included (separate WP needed if working). Spouse visa is one of the most cost-effective long-term residency options.
Non-Immigrant O / O-A / O-X (Retirement): Age 50+ minimum. Standard Non-O retirement requires THB 800K in Thai bank or THB 65K/month income. O-A (issued abroad, 1 year) and O-X (5–10 years, select nationalities) add mandatory health insurance with USD 100K coverage. Cannot work. Best for retirees with stable foreign pensions.
Thailand Privilege Visa (formerly Elite): Membership-based 5/10/15/20-year multi-entry visa with concierge airport service, government-issued fast-track lanes, and no annual reporting beyond 90-day report. One-time fees THB 650,000 to THB 5,000,000 depending on tier (Reserve, Diamond, Gold, Platinum, Privilege). No work permit included but no source-of-income proof required. Ideal for HNW non-workers.
DTV (Destination Thailand Visa): Launched July 2024. 5-year multi-entry, 180 days per stay (extendable +180 once on-shore). Government fee THB 10,000. Aimed at digital nomads, remote workers, freelancers, soft-power category participants (Muay Thai trainees, Thai cooking students, traditional medicine learners). Requires THB 500,000 savings proof. Game-changer for the previously grey-area remote-worker community.
LTR (Long-Term Resident, BOI): 10-year visa, work permit included, annual reporting instead of 90-day, fast-track immigration, tax exemption on foreign-sourced income. Four categories: Wealthy Global Citizen (USD 1M assets + USD 80K income), Wealthy Pensioner (USD 80K income + age 50+), Highly-Skilled Professional (USD 80K income in target industries), and Work-from-Thailand Professional (USD 80K income + employer USD 150M revenue). BOI-administered, 4–6 month processing.
SMART Visa: For investors (THB 20M), executives (USD 200K salary in S-curve industries), startups (BOI-endorsed), and experts in targeted technologies. 4 years validity, work permit included, family bundled.
Work Permits — The Companion to Non-B
A Thai work permit (Bai Anuyat Tham Ngan) is issued by the Department of Employment under the Ministry of Labour, not Immigration. It is mandatory for any work performed on Thai soil, including remote work for foreign employers (with limited DTV/LTR carve-outs). We file WP3 (pre-approval before visa pickup) and WP10 (work permit book) in parallel with the Non-B application, coordinate with the labor office for the in-person signing appointment, and handle annual renewals with full ledger of corporate tax filings and quarterly social security contributions.
90-Day Reporting, Re-Entry, and Compliance
Every foreigner staying in Thailand beyond 90 consecutive days must file a TM47 90-day report — online, by mail, or in person. Missed reports trigger a THB 2,000–5,000 fine and can compound into visa cancellation. Foreigners leaving Thailand must obtain a Re-Entry Permit (single THB 1,000, multiple THB 3,800) or their visa is voided on departure. Landlords or hotels must file a TM30 within 24 hours of foreigner arrival — for those living in private condominiums or houses, the responsibility falls on the tenant. We run a managed-compliance program (THB 12,000/year) that handles all routine reporting, permit renewals, and immigration interactions on your behalf.
Path to Permanent Residency and Citizenship
Foreigners who hold consecutive 1-year Non-B or Non-O extensions for 3+ years, file Thai personal income tax (PND 91) at THB 80K+/month for 3 years, and demonstrate Thai language ability can apply for Permanent Residency during the annual December window. Quota: 100 per nationality per year. Approval typically 18–36 months. PR holders gain: no annual renewal, ability to own real estate condominium freely, easier mortgage approval, and a pathway to Citizenship after 5 more years (or 3 with Thai spouse + Thai child). Our PR success rate for prepared clients is ~60% versus ~30% national average.
Why Foreigners Choose NYC Legal Over Visa Agents and DIY
Most visa agents in Pattaya or Bangkok are unlicensed runners who deliver paperwork but cannot represent you legally, write opinion letters, or handle disputes with Immigration. NYC Legal is a registered law firm with Notary Public attorneys, ISO-aligned document workflows, NDA-protected client files, and direct relationships with Thai MFA, BOI, and Immigration Bureau senior officers. We provide written eligibility opinions before you commit, transparent pricing with no hidden government fees, and bilingual contracts so you always know what you are paying for.
